Terms and Conditions for Schools

1. Agreement and Services

These Terms apply to agreements with schools and school authorities. The service provider is Igor Kogan, Aimathic, Karwendelstr. 25, 81369 Munich, Germany; support@aimathic.com. The scope, term, and fees are set forth in the accepted proposal. The person placing the order must be authorized to bind the school or school authority. Students and teachers do not incur payment obligations merely by using the service.

Aimathic provides tools for working on exercises, AI-assisted learning support, and tools that allow schools to review student activity, without voice functionality. AI responses, solution assessments, and summaries may contain errors. Aimathic does not guarantee any specific learning outcome. Teachers must review results before using them for school-related purposes. The service is not intended to make automated decisions about grades, promotion, or admissions.

2. Use and Access

Aimathic grants the school a non-exclusive right to use the service within the agreed scope and for the agreed period. Personal dashboard accounts may not be shared. Teachers and school administrators can view information across the school; the school may grant this access only to authorized personnel.

Students access the service through individual links that can be disabled. Conversation history is also device-specific. On a different device, the link allows new work under the same profile but does not provide access to previous conversations. The school must distribute links only to intended users and disable any link that is misused. Unlawful content, unauthorized access, and intentional interference with the service are prohibited.

All rights in teaching materials remain with their respective rights holders. The school authorizes the processing necessary to provide the service, including requests to AI models, and must ensure that it has the right to do so.

3. Teaching and Data Protection

The school determines how the service is used in instruction, the applicable legal basis, authorized users, retention periods, and, where applicable, alternatives to using the service. The school must inform the affected data subjects. Aimathic processes school data in accordance with the Data Processing Agreement (DPA). School data is not sold or used for advertising or to train or fine-tune AI models operated by Aimathic or third parties.

4. Operation and Support

Support is available at support@aimathic.com. Any binding response times or availability commitments require a separate agreement. Where practicable, Aimathic will give advance notice of scheduled maintenance expected to cause significant disruption. Security updates and bug fixes must not unreasonably impair the agreed core functionality. Material changes to the service require a contractual basis.

In response to a specific security threat or material breach of contract, Aimathic may suspend access to the extent necessary and proportionate. Where practicable, Aimathic will give advance notice of the reason and how the issue can be resolved. The suspension ends once the reason no longer applies; data return and data subject rights remain unaffected.

5. Term, Payment, and Termination

The agreed term is generally one school year, subject to the specific contract terms. There is no automatic renewal. Invoices are payable within 30 days after receipt. The right to terminate for cause remains unaffected. Data return and deletion are governed by the DPA.

6. Liability and Final Provisions

The statutory rules governing liability and breach of contract apply. German law applies, subject to mandatory statutory provisions. Statutory rules on jurisdiction remain unaffected. Individually negotiated terms take precedence. The DPA controls with respect to data protection matters. Contract amendments must be documented in text form; publishing changes on a website alone does not amend existing contracts.
